By accessing and purchasing services from me, Dawson Bodenhamer, whether through Upwork, www.fortheking.design, or any other platform, you agree to the following terms and conditions, as well as all policies listed on the Policies page. Engaging with my services includes, but is not limited to, submitting a contact form, purchasing a service, signing a contract, or initiating communication with the intent to procure services.


1. Agreement and Website Ownership

This website is owned and operated by me, Dawson Bodenhamer. By engaging with my services, you agree that you have read, understood, and are bound by these Terms and Conditions, which govern your activities on this site and any contractual work agreed upon between us.


2. Age and Legal Authority

To use this website and engage my services, you must be at least 18 years old or the legal age of majority in your jurisdiction. You must have the legal authority, right, and freedom to enter into these Terms as a binding agreement.


3. Ownership and Intellectual Property

All artwork, designs, and other creative works ("Work") created by me are protected by copyright laws. Ownership and copyright of the Work remain with me until full payment (defined as cleared funds in my designated account) has been received. Upon receipt of full payment, ownership and copyright of the final, approved Work are transferred to you.


  • 3.1. Portfolio Rights: I retain the right to showcase the finished work in my portfolio, including but not limited to online portfolios, printed materials, social media, and case studies, unless you explicitly request otherwise in writing prior to final delivery and no later than 14 days after project completion. If your project is particularly cool, I might shed a single artistic tear of joy when adding it to my portfolio. No pressure.

  • 3.2. Client Responsibilities: You are responsible for ensuring you have the necessary rights and permissions for any materials (e.g., logos, images, text) you provide to me for use in the Work. I am not liable for any copyright infringement arising from materials provided by you.

  • 3.2. Prohibited Uses: The Work may not be reproduced, distributed, modified, or used for any purpose other than that explicitly agreed upon in writing without my express prior written permission. Violators will be sentenced to an eternity of slightly wobbly tables at every restaurant they ever visit.

  • 3.3. Kill Fee: If you terminate the project before completion, a kill fee will be assessed based on the percentage of work completed. This fee will be outlined in the project proposal or contract.

6. Changes to Services and Products

I may, without prior notice (except where such changes materially affect an ongoing project), change the services offered or stop providing certain services altogether. I reserve the right to create limits on the use of services or suspend or terminate access at my discretion. If this ever happens, assume one of three things: (1) I was abducted by hyper-intelligent otters who now run the business, (2) I accidentally clicked the ‘Self-Destruct’ button, or (3) it was a perfectly normal business decision, but options 1 and 2 are more fun to imagine.


7. Warranties and Limitations of Liability

I will provide services with reasonable skill and care and will make reasonable efforts to correct any errors in the Work that are brought to my attention within a reasonable timeframe. However, there is no guarantee that the services will be completely error-free or uninterrupted.


To the maximum extent permitted by law, I am not liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, data, or goodwill, arising out of or relating to your use of the services, even if I have been advised of the possibility of such damages. My total liability for any claim arising out of or relating to these Terms or the services provided shall not exceed the total amount paid by you for the specific service in question.

For instance, if my work results in your goldfish developing an inflated sense of self-worth and attempting to run for public office, I cannot be held responsible for the outcome. However, if it wins, I do request an invitation to the victory party.


8. Right to Modify Terms

I reserve the right to modify these Terms and Conditions at any time. Any changes will be posted on this page or communicated directly to you via email to the address you provided. By continuing to use the services after the effective date of the changes, you agree to the updated Terms. If you do not agree to the changes, you should discontinue use of the services. Or build a time machine, go back to when you did agree, and warn your past self. That works too.


9. Promotional Communications

By engaging my services via my website www.fortheking.design, you agree to receive promotional messages and materials from me from time to time. You can opt out of these communications at any time by contacting me directly.


10. Governing Law and Dispute Resolution

These Terms and any disputes arising out of or relating to them will be governed by the laws of Texas, without regard to its conflict of law principles. Any disputes will be resolved in the courts of Texas.
